Amendment to General Application Regulations – Use of Work Equipment
Safety, Health and Welfare at Work (General Application)(Amendment) Regulations 2020 (S.I. No. 2 of 2020)
These Regulations amend the Safety, Health and Welfare at Work (General Application) Regulations 2007 (S.I. No. 299 of 2007) in order to give effect to the provisions of Directive 2009/104/EC of the European Parliament and of the Council of 16 September 2009 concerning the minimum safety and health requirements for the use of work equipment by workers at work.
The Regulations amend certain provisions in Chapter 2 Use of Work Equipment of Part 2 Workplace and Work Equipment of the General Application Regulations in order to facilitate the full transposition of the provisions of Directive 2009/104/EC. The Regulations amended are No.s 27, 32, 36, 38, 39, 41, 42, 43, 48, 50 52, and 55.
The first objective of this legislation is to make Irish law fully aligned with European requirements in the Use of Work Equipment Directive 2009/104/EC.
The second objective is to increase the protection of workers who work on or near excavators used for object handling, by ensuring the technical requirements in domestic law reflect the intentions of the Machinery Directive and relevant harmonised standards.
The third objective is to clarify requirements for operators by distinguishing between the provisions that apply to cranes and provisions that apply to excavators used for object handling.
The Regulations come into operation on 1 April 2020.
